Trial Advocacy and Interactive Mock Trial
Trial skills are essential for elder law attorneys who appear in contested and non-contested hearings in probate and district court and other venues. The retreat pre-session is a 4-hour interactive, intermediate level trial advocacy session led by trial lawyer and advocacy teacher Karen Steinhauser. Based on an elder law hypothetical fact pattern, Ms. Steinhauser will discuss and demonstrate the art and skill of trial advocacy, including the importance of incisive case analysis and persuasive speech. Since trial skills are best acquired by seeing and doing, the group will be divided into two, and attendees will have the opportunity to practice their skills in a supportive atmosphere with constructive feedback. The session will include trial evidence, opening statement, direct and cross examination of expert witnesses, and closing argument. Expert witnesses will provide testimony by direct and cross examination.
